RELAY / TERMS

Terms of Service

Effective date: September 27, 2026

Service: Relay at relayapp.net and related desktop, mobile, voice, video, and web applications
Operator: Nathan Wesley Breeden
Contact: nate.breeden@outlook.com

1. Agreement and who may use Relay

These Terms of Service ("Terms") are an agreement between you and Nathan Wesley Breeden ("Relay," "we," "us," or "our") for use of Relay, including relayapp.net, its apps, servers, channels, messages, voice/video features, uploads, discovery pages, and related services (together, the "Service").

By creating an account, clicking an acceptance box, or using the Service, you agree to these Terms and the Privacy Policy below. If you do not agree, do not use Relay.

You must be at least 13 years old to use Relay. If you are under the age of legal adulthood where you live, you may use Relay only with permission and supervision from a parent or legal guardian, who must agree to these Terms on your behalf where required by law. A parent or guardian who allows a minor to use Relay is responsible for helping the minor understand and follow these Terms. Relay is not designed for children under 13. Do not create an account for a child under 13 or submit their personal information. We may suspend or close an account if we reasonably believe the age requirements are not met. Applicable child privacy laws still apply.

You confirm that information you submit is accurate and that you will keep it reasonably up to date. Do not misrepresent your age or identity, impersonate another person, or use Relay if doing so would violate a law or restriction that applies to you.

2. Your account and security

You are responsible for activity through your account, to the extent allowed by law. Keep your password and verification links private, use a secure email account, and tell us promptly at nate.breeden@outlook.com if you believe someone accessed your account without permission. We may ask you to verify account ownership before making changes.

You are responsible for the accuracy and security of the email address attached to your account. Losing access to that email, forgetting login information, or being unable to complete verification may prevent account recovery. We do not promise that every account can be recovered.

Do not sell, rent, transfer, or share an account except where Relay expressly provides a feature for it. You may not bypass account restrictions by creating replacement accounts.

3. User content and conduct

"User Content" means material submitted, transmitted, posted, stored, streamed, or shared through Relay, including usernames, profile information, messages, files, images, links, audio, video, screen shares, server or channel names, and moderation reports.

You keep whatever rights you have in your User Content. You give Relay a limited, non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, and technically adapt your User Content only as reasonably needed to operate, secure, maintain, moderate, and improve the Service, and to respond to legal requirements. This license ends when the content is deleted from active systems, except that copies may remain in backups, recipients' accounts, moderation records, or legal records for a limited time or where retention is permitted or required by law.

You are responsible for your User Content and for making sure you have the rights and permissions needed to share it. You must not use Relay to:

  • Break the law, encourage or help others break the law, or evade a lawful order.
  • Threaten, harass, stalk, bully, exploit, defraud, or seriously invade another person's privacy.
  • Share another person's private information, account credentials, or intimate material without permission.
  • Upload malware, attempt to compromise accounts or systems, interfere with the Service, or probe Relay's security without written authorization.
  • Infringe copyrights, trademarks, privacy rights, or other rights.
  • Promote or distribute illegal goods or services, or use Relay to arrange illegal transactions.
  • Share sexual or exploitative content involving anyone under 18, or content that is otherwise unlawful.
  • Use Relay to spam, send deceptive links, impersonate Relay staff, manipulate discovery, or evade a block, ban, or other enforcement action.
  • Record or redistribute another person's voice, video, or screen share where you lack consent or where doing so violates law or Relay's rules.
  • Encourage harm or provide content that is unlawful or creates a serious safety risk.

These examples are not exhaustive. Relay may publish additional community rules and apply them to the Service. Do not assume that content is allowed just because it remains visible.

4. Servers, channels, administrators, and moderation

Users who create or manage a server ("Server Administrators") control that server's membership, channels, roles, permissions, invites, and server-level rules, subject to these Terms and applicable law. Server Administrators are responsible for setting appropriate permissions, protecting invite links and staff access, and handling their members' reports. Relay does not guarantee that a server is safe, accurate, active, private, or suitable for you.

Relay may provide reporting, blocking, filtering, age-gating, or moderation tools, but tools may be incomplete or unavailable. Channel permissions and private-server settings reduce visibility but may not prevent screenshots, copying, forwarding, access by authorized staff, technical errors, or access by people who obtain an invite. Do not share information in Relay that you need to keep absolutely confidential.

We may, but are not required to, review or investigate activity or User Content. We may remove, restrict, label, disable, or refuse to distribute content; limit features; reset credentials or sessions; suspend or terminate accounts; restrict servers; revoke badges or verification; or take other action when we reasonably believe it is needed to protect users, Relay, third parties, or comply with law. We may act based on reports, automated signals, staff review, or other information. We may make mistakes, and we may not be able to provide advance notice or a detailed explanation in every case.

Moderation decisions may include warnings, content removal, channel or server restrictions, temporary suspension, permanent account termination, or other measures. We may preserve relevant records and disclose information where required or permitted by law. Where available, you may appeal an action by emailing nate.breeden@outlook.com. An appeal does not guarantee reversal or a response by a specific date.

Relay does not promise to prevent every harmful, offensive, illegal, or otherwise objectionable item from appearing. Users may encounter inaccurate, disturbing, offensive, or unlawful material posted by other users or linked from outside Relay. Use blocking and reporting tools, leave spaces that make you uncomfortable, and report urgent safety or legal concerns to nate.breeden@outlook.com or through the official Relay server. Relay is not an emergency service. Contact local emergency services for immediate danger.

5. Data loss, resets, availability, and changes

Relay is a developing service. Features may change, be interrupted, become unavailable, or be discontinued. We do not promise uninterrupted access, permanent storage, message delivery, recovery of deleted content, or that User Content will always remain available.

To the maximum extent allowed by law, Relay is not responsible for loss, corruption, deletion, failed delivery, unauthorized alteration, or inability to access User Content, accounts, messages, server settings, roles, badges, or other data, including loss resulting from technical failure, maintenance, security incidents, user error, account compromise, moderation, account resets, third-party services, or discontinuation of the Service. This does not remove any responsibility that applicable law does not allow us to exclude.

You should keep your own copies of information you cannot afford to lose. Do not treat Relay as your only archive, backup, emergency communication method, or recordkeeping system. We may reset, restore, restrict, or remove accounts or data to investigate abuse, fix technical problems, respond to security incidents, enforce these Terms, or comply with law. We do not promise advance notice or recovery.

6. Third-party services and links

Relay may rely on or link to third-party websites, software, hosting, email delivery, storage, voice/video, analytics, or other services. Those services may have their own terms, privacy practices, availability limits, and security risks. Relay does not control third-party services and is not responsible for their independent acts or failures, to the extent allowed by law. Your use of them may be subject to their own terms. Relay's Privacy Policy explains the general categories of service providers that may process information for Relay.

7. Relay's intellectual property

Relay and its software, branding, design, and materials are owned by or licensed to Nathan Wesley Breeden and protected by applicable intellectual property laws. These Terms give you a limited, revocable, non-transferable right to use the Service for personal, lawful purposes in line with these Terms. You may not copy, modify, reverse engineer, sell, sublicense, or exploit Relay except where the law allows or we give written permission.

If you send ideas or suggestions, you allow Relay to use them without restriction or payment, unless the law says otherwise.

8. Copyright complaints

If you believe content on Relay infringes your copyright, send a notice to nate.breeden@outlook.com with the information required by applicable copyright law, including identification of the copyrighted work, the material you believe infringes it, your contact details, a good-faith statement, and a statement under penalty of perjury that your notice is accurate and that you are authorized to act. Do not send false or incomplete claims. Relay may remove or restrict reported material and may terminate repeat infringers where appropriate.

If Relay relies on U.S. copyright safe-harbor procedures, the operator must complete the required registration and maintain a compliant notice process. Listing a contact here alone does not establish eligibility for any legal safe harbor.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." RELAY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND THAT THE SERVICE WILL BE SECURE, ERROR-FREE, OR FREE OF HARMFUL CONTENT.

Relay does not endorse or guarantee User Content, users, servers, Server Administrators, links, or third-party services. We do not promise to detect or remove every unlawful or harmful item, prevent every account compromise, or resolve every dispute between users. Nothing in these Terms excludes a warranty or right that cannot legally be excluded.

10. Limits on liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATHAN WESLEY BREEDEN AND RELAY'S OWNERS, STAFF, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOST REVENUE; LOST DATA; LOSS OF GOODWILL; BUSINESS INTERRUPTION; OR COSTS OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO RELAY OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES COULD OCCUR.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF NATHAN WESLEY BREEDEN FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID RELAY FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50.

These limits apply only to the extent lawful. They do not limit liability that applicable law does not allow to be limited, including any rights that cannot be waived, or liability for the operator's fraud, willful misconduct, or other categories that applicable law excludes from limitation. Some places do not allow certain exclusions or caps, so some parts may not apply to you.

11. Indemnity

To the extent allowed by law, you agree to reimburse and protect Nathan Wesley Breeden from third-party claims and reasonable costs that result from your unlawful use of Relay, your material breach of these Terms, or your User Content violating another person's rights. This does not require you to cover a claim caused by Relay's own conduct where applicable law prohibits that result. If you are a minor, this section applies only to the extent it is enforceable under the law that applies to you.

12. Suspension and termination

You may stop using Relay at any time. You may request account deletion by emailing nate.breeden@outlook.com or submitting a support ticket through the official Relay server. We may suspend or terminate access, remove content, or discontinue all or part of the Service as described in these Terms. We may retain limited information after termination as described in the Privacy Policy, including information needed for security, moderation, legal compliance, dispute resolution, or backup recovery.

Sections that by their nature should continue after termination will continue, including provisions about User Content licenses for retained copies, intellectual property, disclaimers, liability limits, indemnity, disputes, and legal compliance.

13. Governing law and disputes

These Terms are governed by the laws of Tennessee, without applying conflict-of-law rules, except where consumer protection laws require otherwise. Any court proceedings must be brought in Tennessee, unless applicable law gives you the right to bring a claim elsewhere. Nothing in this section prevents either party from seeking relief in a court or waives rights that cannot legally be waived.

14. Changes and contact

We may update these Terms. We will change the effective date above and, when a change is material, provide notice through Relay or another reasonable method. Continued use after the updated Terms take effect means you accept them where permitted by law. If you do not agree, stop using Relay and request account deletion.
